Terms and Conditions

At Talking Stories, we believe in creating clear expectations and maintaining professional relationships with our clients. These terms and conditions are designed to protect both you and our team, ensuring a smooth and enjoyable storytelling experience. While legal language can be complex, we've aimed to make these terms as clear as possible. We encourage you to read them carefully before booking our services, and please don't hesitate to contact us if you have any questions.

 

1. Service Agreement

- These terms govern all services provided by Talking Stories ("we," "our," "us") to clients ("you," "your").

- By booking our services, you agree to these terms in full.

- We reserve the right to modify these terms with 30 days' notice.

 

2. Booking and Payment

- Full payment or an agreed deposit is required to secure your booking.

- For Story Sessions and Narrative Sessions, full payment is required before we start the first step of the 5-step process.

- For Studio projects, payment terms will be outlined in your custom proposal.

- Where applicable remaining balance is due 7 days before your scheduled session.

- The Legacy Box fee ($60) is charged separately and is non-refundable once produced.

 

3. Cancellation and Rescheduling

- Cancellations made within 7 days of purchase: Full refund minus 20% booking charge.

- Cancellations made with 7-14 days of purchase: 50% refund minus 20% booking charge.

- Cancellations after 14 days of purchase: No refund.

- One free rescheduling is permitted with at least 48 hours' notice.

- Additional rescheduling incurs a $100 administration fee.

 

4. Session Delivery

- Session duration is as specified in your package (3.5 hours for Story Sessions, 6 hours for Narrative Sessions).

- Additional time may be purchased at $200 per hour.

- Travel fees may apply for locations outside the Southeast Queensland region.

- We reserve the right to reschedule due to illness, equipment failure, or force majeure

 

5. Content and Copyright

- You retain ownership of your personal stories and information.

- We retain copyright of all photographs, audio recordings, and produced materials.

- You receive a perpetual license to use the delivered materials for personal/organisational use.

- Commercial use of any materials requires written permission.

- We reserve the right to use portions of the content for promotional purposes unless explicitly agreed otherwise.

 

6. Delivery of Materials

- Digital files will be delivered within 30 days of your session.

- Physical materials (Legacy Box) will be delivered within 45 days.

- Files will be available for download for 7 days.

- Additional 7 days may be requested for download.

- Additional copies of the Legacy Box may be purchased for $60 each.

- Archive copies may be requested within 12 months of your session.

 

7. Quality Guarantee

- We guarantee professional quality audio and photographic capture.

- Retakes will be offered at no cost if technical issues affect quality.

- Editorial decisions regarding content remain at our discretion.

- Additional editorial edits may be requested at an additional cost, payment terms will be outlined in your custom proposal.

- Minor adjustments to final audio can be requested during or after Step 3, but before Step 4.

- Minor adjustments to final audio can be requested within 14 days of delivery.

- One round of minor revisions is included; additional revisions charged at hourly rate.

 

8. Privacy and Confidentiality

- We maintain strict confidentiality of all shared information.

- Private information will not be shared without explicit permission.

- You control the privacy settings of your shared webpage.

- Raw recordings are archived securely for 12 months.

- You may request deletion of archived materials at any time.

 

9. Property Rights and Usage

- You grant us the right to photograph and record at designated locations.

- You confirm you have authority to share stories and information provided.

- You are responsible for obtaining necessary permissions from third parties mentioned.

- We may decline to record content that violates our ethical guidelines.

 

10. Liability

- Our liability is limited to the total amount paid for services.

- We maintain professional indemnity insurance.

- We are not liable for consequential or indirect losses.

- Force majeure may affect delivery timelines.

- You accept responsibility for accuracy of provided information.

 

11. Conduct Towards our Story Producers

- Our storytellers (interviewers and photographers) must be treated with respect and professionalism.

- We reserve the right to terminate sessions immediately if clients or participants display:

  • Discriminatory behavior or harassment of any kind

  • Aggressive or threatening conduct

  • Inappropriate advances or comments

  • Intoxication during sessions

- No refund will be provided if a session is terminated due to inappropriate conduct

- Storytellers are not required to work beyond their scheduled hours or in unsafe conditions

- Our team will provide reasonable accommodations for participants but maintain professional boundaries

- Clients must inform us in advance of any special requirements or potential concerns
